1. Who these terms are between

These terms are between Jiaqi Pan SL, a Spanish limited company (Sociedad Limitada) with tax ID (CIF) B04942223, Carrer Coma 31, 08173 Sant Cugat del Vallès, Barcelona, Spain (“AgentPage”, “we”) and the person or organisation that creates an account (“you”). If you use AgentPage for an organisation, you confirm that you have authority to bind it.

AgentPage is for business use. By creating an account or connecting AgentPage to an AI tool, you accept these terms. You must be at least 18 years old.

2. The service

AgentPage lets you, from inside ChatGPT, Claude or a similar AI tool, create a chat for your website that talks to visitors, collects their contact details, emails you each lead and sends you a report. The chat runs on Landbot’s platform, which acts as our sub-processor. The service is described in the docs. We may change, add or remove features, and some features are intentionally absent for now.

The chat is an automated assistant. It can be wrong or incomplete. You are responsible for checking what it says on your behalf and for following up with leads yourself.

3. No charge

AgentPage is currently provided without charge. We do not ask for, or accept, payment. If we introduce paid plans, we will offer them separately with their own terms, and they will not apply to you unless you accept them. We may limit use of the service to protect it, for example by capping how many chats, previews or conversations an account can have.

4. Your account

  • You sign in with a link sent to your email address. Keep your inbox secure. You are responsible for what happens under your account.
  • Give us accurate information and keep it up to date.
  • Tell us promptly if you think someone else has access to your account.
  • You may close your account at any time by emailing support@getagent.page from the address on the account.

5. Using ChatGPT, Claude and other AI tools

You connect AgentPage to your AI tool yourself, under your own agreement with its provider. We do not control that tool, and we are not responsible for how it behaves or for what it does with data you ask it to bring from AgentPage. The tool may take actions on your instruction. Check what it is about to do, especially when you ask it to change your chat. We never ask for passwords, API keys or payment card numbers, and you must not give them to your AI tool for use with AgentPage.

6. Your responsibilities as controller

For the personal data of the people who use the chat on your website, you are the controller and AgentPage is your processor. In particular, you are responsible for:

  • having a lawful basis to collect visitors’ data and to contact them, and for any consent or notice the law requires where your visitors are;
  • giving your visitors a clear privacy notice that covers the chat and AgentPage as your provider (the docs have suggested wording), and a cookie notice where required for the chat’s use of browser storage;
  • keeping the notice that the chat is an automated assistant. You must not remove it, hide it or configure the chat to pretend to be a person;
  • answering visitors’ requests to access, correct or delete their data. We will help, as set out in the DPA;
  • the content of your website and of the greeting and questions you set, and for having the right to let us read your public pages to build the chat;
  • any marketing or follow-up you do with the leads. We never contact your leads for you;
  • complying with the rules that apply to your business or sector.

AgentPage is not designed for regulated advice, emergency services or any use where an error by an automated chat could cause serious harm. Do not use it for those.

7. Acceptable use

You must not use AgentPage, and must not let anyone else use it through your account, to:

  • send spam or unsolicited commercial messages, or contact people without a lawful basis;
  • break the law, infringe anyone’s rights, or host or encourage illegal, abusive, hateful, deceptive, harassing or sexually explicit content;
  • collect passwords, API keys or other credentials, payment card numbers, government identifiers, health information or other special-category data, or to ask visitors for them;
  • target children under 13 or collect data from them;
  • mislead visitors about who they are talking to, or impersonate a person or organisation;
  • add the chat to a website you do not own or control, or to read pages you have no right to read;
  • attempt to access another customer’s data, probe or test the security of the service without our written permission, or bypass limits or rate limits;
  • distribute malware, overload the service, or interfere with the people or systems that run it;
  • use the service to build a competing product by copying it, or resell it without our written agreement.

We may remove content, pause a chat or suspend an account that breaks this section, and report illegal activity to the authorities.

8. Content and licences

You keep all rights in your website content, your settings and the data your chat collects. You give us a licence to use them, only as needed to run the service for you: to read your public pages, build and run your chat, store and send your leads and reports, and keep the service secure. We keep all rights in the service. If you send us feedback, we may use it without restriction or payment.

9. Data protection and the DPA

Our privacy policy explains how we handle personal data. Our data processing terms (the “DPA”) form part of these terms and apply to the personal data of your website visitors that we process for you. In short, we:

  • process visitor data only on your documented instructions, which are these terms and your use of the tools;
  • keep it confidential and secure;
  • use only the sub-processors named in the privacy policy, and tell you before we add or replace one;
  • help you answer visitors’ requests and meet your own data protection duties;
  • tell you about a personal data breach without undue delay; and
  • delete or return the data when the service ends.

If the DPA and these terms conflict on personal data, the DPA applies.

10. Third-party providers

AgentPage relies on third-party providers, including Landbot for the chat and Cloudflare for hosting. If a provider fails, changes its service or ends our access, AgentPage may be interrupted or stop. We are responsible to you for our providers as set out in these terms, but we do not promise that they will be available.

11. Availability and support

We aim to keep AgentPage running but do not promise any level of availability while it is provided without charge. We may carry out maintenance or make changes at any time. Support is by email at support@getagent.page on a reasonable-efforts basis; see Support.

12. Suspension and termination

  • You may stop using AgentPage and close your account at any time.
  • We may suspend or end your access immediately if you break these terms or the law, if your use puts the service, our providers or other people at risk, or if a provider or the law requires it. Where we reasonably can, we will tell you first and give you a chance to fix the problem.
  • We may end the service. We will give you at least 30 days notice by email, unless the law or a security need requires shorter notice.
  • When your access ends, you can ask for an export of your leads for 30 days. After that, we delete your data as set out in the privacy policy. Sections that by their nature continue (including 8, 13 to 15, 17 and 18) will continue to apply.

13. No warranty

The service is provided “as is” and “as available”. To the fullest extent the law allows, we give no warranty that the service will be uninterrupted or error-free, that the chat’s answers will be correct, that any lead will be captured or delivered, or that it will produce any result for your business. Nothing in these terms limits any right you have by law that cannot be limited.

14. Limit of liability

Nothing in these terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or anything else that cannot be limited by law.

Subject to that, we are not liable for loss of profit, revenue, leads, business, goodwill or data, or for indirect or consequential loss. Our total liability to you for all claims arising out of or in connection with the service in any twelve-month period is limited to €100.

15. Indemnity

You will compensate us for losses, costs and claims brought by a third party (including a visitor or a regulator) to the extent they arise from your website content, from the data you collect through the chat or how you use it, or from your breach of section 6 or 7. We will tell you promptly about any such claim and let you take part in dealing with it.

16. Changes to these terms

We may change these terms. For a material change, we will email you at least 30 days before it takes effect. If you keep using AgentPage after that, you accept the new terms. If you do not accept them, stop using AgentPage and close your account.

17. Governing law and disputes

These terms are governed by the law of Spain. The courts of Barcelona, Spain have exclusive jurisdiction, except where the law of your country gives you the right to bring a claim elsewhere. Please contact us first at support@getagent.page so that we can try to resolve the problem informally.

18. General

  • These terms, the privacy policy and the DPA are the whole agreement about the service.
  • If part of these terms is unenforceable, the rest still applies.
  • You may not transfer your rights under these terms without our written consent. We may transfer ours to a successor of the service, and we will tell you.
  • A failure to enforce a right is not a waiver of it.
  • We will give notices to the email address on your account. You can reach us at support@getagent.page or Carrer Coma 31, 08173 Sant Cugat del Vallès, Barcelona, Spain.
  • Neither of us is liable for a delay or failure caused by events beyond our reasonable control, including a failure of an internet, hosting or AI provider.
